TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using EvaSphere ("Service", "Platform", "EvaSphere", "we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must discontinue use of the Service.

2. Description of the Service

EvaSphere is a cloud-based Software as a Service (SaaS) platform designed to facilitate interactive virtual learning environments, educational activities, real-time participation, classroom engagement, and collaborative learning experiences. The Service may be offered through free and paid subscription plans.

3. Eligibility

You must be legally capable of entering into a binding agreement under applicable law to create and manage a teacher account. Students may participate in learning sessions without creating an account, subject to the instructions and supervision of their educator or institution where applicable.

4. Teacher Accounts

Teacher accounts are authenticated exclusively through Google Sign-In. You are responsible for:

Maintaining access to your Google account.
Protecting your authentication credentials.
All activities conducted through your account.

You agree to provide accurate account information and to keep such information reasonably current.

5. Student Participation

Students may join sessions using a display name, nickname, or other identifier chosen by the participant. EvaSphere does not require students to create accounts in order to participate in classroom activities. Teachers remain responsible for the educational use of the Service within their sessions.

6. User Content

Users may create, upload, submit, display, or generate content through the Service, including but not limited to:

Educational materials
Presentations
Activities
Polls
Quizzes
Collaborative board submissions
Student responses

You retain ownership of content that you create or upload. By using the Service, you grant EvaSphere a limited, non-exclusive, worldwide license to process, store, transmit, and display such content solely as necessary to provide and operate the Service. You are solely responsible for any content you create, upload, or share.

7. Intellectual Property

The EvaSphere platform, software, source code, branding, visual elements, interfaces, features, documentation, and related intellectual property are owned by EvaSphere or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of EvaSphere intellectual property to any user.

8. Acceptable Use

You agree not to:

Violate applicable laws or regulations.
Upload unlawful, fraudulent, harmful, or infringing content.
Attempt unauthorized access to systems or accounts.
Interfere with platform security or functionality.
Distribute malware or malicious code.
Reverse engineer or attempt to extract source code except where permitted by law.

We reserve the right to suspend or terminate access for violations of these Terms.

9. Subscriptions and Billing

Certain features may require a paid subscription. Payment processing, billing management, invoicing, refunds, subscription renewals, payment methods, and related financial services are provided by third-party payment providers. EvaSphere does not directly process or store payment card information. Subscription-related transactions are subject to the terms, policies, and requirements of the applicable payment provider. Pricing, features, and subscription offerings may be modified at any time.

10. Third-Party Services

The Service may integrate with third-party services, including but not limited to:

Google Authentication
Firebase services
Payment processing providers

Your use of such services may be subject to separate agreements, terms, and privacy policies established by those providers. EvaSphere is not responsible for the availability, content, or practices of third-party services.

11. Service Availability

We strive to maintain reliable service availability; however, the Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee:

Continuous availability
Error-free operation
Uninterrupted service
Compatibility with all devices or browsers

Maintenance, upgrades, outages, or technical issues may affect availability.

12. Account Suspension and Termination

We may suspend or terminate access to the Service if:

These Terms are violated.
Fraudulent activity is detected.
Security risks are identified.
Required by law.

Users may discontinue use of the Service at any time.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied. EvaSphere disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

14. Limitation of Liability

To the maximum extent permitted by law, EvaSphere shall not be liable for:

Indirect damages
Consequential damages
Special damages
Incidental damages
Loss of profits
Loss of data
Loss of business opportunities

In no event shall EvaSphere's total liability exceed the amount paid by the user to EvaSphere during the twelve (12) months preceding the event giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless EvaSphere from claims, damages, liabilities, costs, and expenses arising from:

Your use of the Service.
Your content.
Violations of these Terms.
Violations of applicable laws.

16. Modifications

We may update these Terms periodically. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Costa Rica, without regard to conflict of law principles.

PRIVACY POLICY

1. Overview

EvaSphere is designed around privacy-conscious principles and aims to minimize the collection of personal information whenever reasonably possible. This Privacy Policy explains how information is collected, used, processed, and protected when using the Service.

2. Information We Collect

The information collected depends on how the Service is used.

Teacher Information: When a teacher authenticates through Google Sign-In, we may receive: Name, Email address, Google account identifier, Profile image (if available).
Student Information: Students are generally not required to create accounts. Participants may join sessions using a nickname, display name, or other identifier selected by the participant.
Activity Data: The Service may process: Poll responses, Quiz answers, Interactive activity submissions, Collaborative board contributions, Session participation data.

3. How Information Is Used

Information may be used to:

Provide platform functionality.
Authenticate users.
Operate learning sessions.
Generate reports.
Improve service performance.
Prevent abuse and maintain security.
Fulfill legal obligations.

4. Session Data and Responses

Student responses and activity submissions may be temporarily processed and stored to enable real-time educational functionality. Teachers may also download, export, or locally store reports generated from session activities. EvaSphere has limited control over information stored locally by educators after export or download.

5. Infrastructure Providers

EvaSphere utilizes third-party infrastructure providers to operate the Service. These providers may process information on our behalf for purposes including:

Authentication
Database operations
Cloud storage
Hosting
Performance monitoring
Service delivery

6. Payment Processing

Payment information is handled by third-party payment providers. EvaSphere does not directly collect, store, or process payment card information. Payment-related information is governed by the privacy policies and terms of the applicable payment provider.

7. Cookies and Local Storage

The Service may use cookies, browser storage, local storage, session storage, and similar technologies for:

Authentication
Preferences
Security
Performance
Core functionality

Users may restrict certain storage mechanisms through browser settings, although doing so may affect functionality.

EvaSphere is intended for educational environments. Students may participate under the supervision of educators, institutions, parents, or guardians where applicable. The Service is designed to minimize the collection of personal information from student participants.

Information may be processed, transferred, and stored in jurisdictions different from the user's country of residence. By using the Service, users acknowledge and consent to such processing where permitted by law.
